Terms&Conditions

These Terms & Conditions apply to all purchases made through Lively Ebikes.

Lively Ebikes is operated by Denis Baciu trading as Lively Ebikes, a sole trader based in East London, United Kingdom.

By placing an order, you agree to the terms below.

1. Age Requirement

Due to the high-powered nature of our products, customers must be 18 years or older to purchase.

By placing an order, you confirm that you are at least 18 years of age.

2. Product Use & Legal Compliance

High-powered conversion kits (including 1500W–3000W systems and 72V batteries) are sold for off-road use only, unless professionally restricted to meet local road regulations.

It is the customer’s responsibility to:

  • Ensure compliance with UK road laws

  • Restrict power output where required

  • Use products safely and responsibly

Lively Ebikes accepts no responsibility for unlawful road use.

3. Installation Responsibility

Products are supplied as components and require correct installation.

Customers are responsible for:

  • Proper installation

  • Safe wiring

  • Secure mounting

  • Compatibility with their bicycle

Professional installation is strongly recommended.

Lively Ebikes is not liable for damage caused by incorrect installation, misuse, modification, or improper maintenance.

4. Orders, Delivery Confirmation & Chargeback Protection

To protect against fraudulent claims and payment disputes, Lively Ebikes maintains detailed records for all transactions and deliveries.

All high-value orders are shipped using signature-required delivery services. Delivery is considered complete when the courier confirms successful delivery to the address provided at checkout and obtains a signature.

We retain the right to use the following evidence in the event of a dispute:

  • Courier tracking records

  • Signature confirmation

  • GPS delivery confirmation (where available)

  • Timestamped dispatch records

  • Order confirmation logs

  • IP address and checkout data

  • Customer communication history

If a customer believes an item has not been received or is defective, they must contact us directly at support@lively-ebike.co.uk before initiating any payment dispute.

Customers must allow reasonable time for investigation and support resolution.

In the case of a reported defect, customers must:

  • Provide clear photographic or video evidence

  • Allow troubleshooting assistance

  • Follow reasonable diagnostic instructions

Failure to contact us prior to initiating a chargeback may result in full contestation of the dispute with all supporting evidence provided to the payment processor.

False “item not received” claims after confirmed signature delivery, or disputes filed without attempting resolution, may be reported to relevant authorities and fraud prevention agencies where appropriate.

By placing an order, you confirm that:

  • The payment method used is authorised by you

  • The delivery address provided is accurate

  • You understand that confirmed signature delivery constitutes proof of receipt
     

5. Shipping & Risk Transfer

Goods remain the responsibility of Lively Ebikes until delivered to the customer.

Once delivery is confirmed via signature, risk transfers to the customer.

Customers must report delivery damage within 24 hours and provide photographic evidence.

Failure to report within this timeframe may affect courier claim eligibility.

6. Cancellation Rights (UK Distance Selling)

In accordance with the Consumer Contracts Regulations 2013, customers have the right to cancel their order within 14 days of receiving the goods.

To exercise this right, customers must notify us in writing.

Returned items must:

  • Be unused

  • Be in original packaging

  • Be in resellable condition

Customers are responsible for return shipping costs unless the item is faulty.

Refunds are processed after inspection.

Custom & Made-to-Order Products

72V custom-built batteries are made to order and exempt from cancellation rights once production has commenced.

7. Warranty

A 12-month warranty is provided on electrical components only.

Warranty covers manufacturing defects.

Warranty does not cover:

  • Incorrect installation

  • Water damage

  • Physical damage

  • Over-voltage use

  • Improper storage

  • Misuse or modification

  • Normal wear and tear

Customers are responsible for shipping costs when returning items for warranty assessment. Replacement or repair will be provided where a fault is confirmed.

Customers must allow Lively Ebikes the opportunity to diagnose and resolve any issue before initiating a payment dispute.

8. Battery Safety & Storage

Lithium battery systems must be handled, charged, and stored responsibly.

Customers agree to the following:

  • Batteries must be stored in a dry, well-ventilated indoor environment.

  • Batteries must be kept at normal room temperature (approximately 10°C–25°C).

  • Batteries must not be exposed to excessive heat, freezing temperatures, moisture, or direct sunlight.

  • Batteries must not be left inside vehicles during extreme hot or cold weather.

  • Only the supplied or approved charger must be used.

  • Batteries must not be opened, punctured, modified, or tampered with.

  • Lithium batteries must not be left charging unattended.

Damage resulting from improper storage, environmental exposure, misuse, or unauthorised modification is not covered under warranty.

9. Limitation of Liability

To the fullest extent permitted by law, Lively Ebikes shall not be liable for:

  • Indirect or consequential losses

  • Loss of earnings

  • Injury resulting from misuse

  • Damage caused by incorrect installation

Nothing in these terms excludes liability for death or personal injury caused by proven negligence.

10. Indemnity

By purchasing and using our products, you agree to indemnify and hold harmless Lively Ebikes from any claims, damages, or liabilities arising from improper use, unlawful use, or modification of products supplied.

11. Governing Law

These Terms & Conditions are governed by and interpreted in accordance with the laws of England and Wales.

If you reside in Scotland or Northern Ireland, you may also bring proceedings in your local courts, and any mandatory consumer protection laws applicable in your jurisdiction will apply.
